OCR Targets Healthcare Risk Analysis Failures in 2026 Enforcement Push — Not Just Breaches

A lot of healthcare organizations and their business associates think HIPAA enforcement only happens after a breach. OCR is changing that. As of early 2026, OCR confirmed it will expand its risk analysis enforcement initiative to also require evidence of actual risk management — not just identifying risks, but documenting what you did to reduce them in a timely way. In 2025, 76 percent of enforcement actions included a penalty for a risk analysis failure. OCR is also now penalizing breach notification failures, meaning if you discovered a breach and did not notify affected individuals and HHS within 60 days, that is a separate enforcement exposure on top of whatever caused the breach. These enforcement trends mean that HIPAA compliance is not a one-time audit exercise — it is an ongoing documented process. If you are a covered entity or a business associate and you cannot produce a current risk analysis with documented remediation actions, you have a compliance gap that exists independent of whether you have ever experienced a breach.
